Attempt on Eligio Rebolledo Salinas’ life and arbitrary detention of Miguel Rebolledo, Victor Rebolledo Salinas and Modesto Rebolledo Salinas, ejidatarios (peasants that own common land) from Guerrero, Mexico

On September 23 an attempt against a member of the farmer community of El Limon was committed followed by the arbitrary detention of three other members of the same community located in the State of Guerrero (Mexico).

Dear Sirs,

I received this information about the attempt on Eligio Rebolledo's life and arbitrary detention of Miguel Rebolledo, Victor Rebolledo Salinas, Modesto Rebolledo Salinas in Guerrero from the Latin American Human Rights Committee (CDAHL) a Canadian organization that exists since 1976 committed to safeguarding the human rights situation all over Latin America. As a Canadian, I was disturbed about the facts.

I have been questioning the arbitrary detention of Miguel Rebolledo, Victor Rebolledo Salinas y Modesto Rebolledo Salinas the morning of September 03. This violation to their human rights sums up to Eligo Rebolledo Salinas life attempt, who was harmed by five gun shots on August 23.

I have received information stating that the Rebolledo Salinas Family is an important part of the movement that has been fighting, for the last two years, against a mining company affiliated to a Canadian transnational firm that operates in the municipality of Cocula.

We ask you to guarantee the freedom Miguel Rebolledo, Victor Rebolledo Salinas y Modesto Rebolledo Salinas

Consequently we:

1.- Lament the violent detention - that failed to show a detention writ or the motives or possible reasons of the judicial action - not only violated their right to a pertinent procedure, but also their basic individual guarantees.

2.- Recall that crime invention and judicial arbitrary, do not reconstruct the institutional weakness of the Guerrero Justice System, neither the need of credibility and legitimacy of it before the citizens of the State.

3. Request putting an end to criminalizing the just and legal citizen’s resistance and the liberation of peasants Miguel Rebolledo, Victor Rebolledo y Modesto Rebolledo

4.- Ask for ensuring the application of the Human Rights International Humanitarian Law.

5.- Demand to guarantee the application of the Declaration on Human Rights Defenders adopted by the General Assembly on August 9 1998, particularly the parts related to the right to “promote and to strive for the protection and realization of human rights and fundamental freedoms at the national and international”(art.1) and that related to the responsibility of the State to “ensure the protection [...] of everyone, individually and in association with others, against any violence, threats, retaliation, de facto or de jure adverse discrimination, pressure or any other arbitrary action as a consequence of his or her legitimate exercise of the rights referred to in the present Declaration” (art.12.2);.

6.- In general, we invite you to respect human rights as well as fundamental rights in the whole country in compliance to the International Norms on Human Rights ratified by Mexico

Asunto: Atentado a la vida de Eligio Rebolledo Salinas y detención arbitraria de los ejidatarios Miguel Rebolledo, Víctor Rebolledo Salinas, Modesto Rebolledo Salinas en Guerrero, Mexico

Señores,

Recibí esta información sobre el Atentado a la vida de Eligio Rebolledo Salinas y detención arbitraria de los ejidatarios Miguel Rebolledo, Víctor Rebolledo Salinas, Modesto Rebolledo Salinas en Guerrero de parte del Comité por los derechos humanos en América Latina (CDHAL), un organismo canadiense que existe desde 1976 y que se encarga de vigilar la situación de derechos humanos a lo largo de Latinoamérica, y como canadiense me preocupó mucho dicho hecho.

He estado interpelado por la detención arbitraria de los ejidatarios Miguel Rebolledo, Víctor Rebolledo Salinas y Modesto Rebolledo Salinas la mañana del 03 septiembre. Esta violación a los derechos humanos de los ejidatarios mencionados se suma al atentado a la vida del ejidatario Eligio Rebolledo Salinas, quien el pasado 23 de agosto fue herido por cinco proyectiles de armas.

He recibido informaciones que los señores de la familia Rebolledo Salina son parte destacada de las personas que vienen dando desde hace dos anos una lucha contra una empresa minera subsidiaria de una empresa transnacional canadiense, en el Municipio de Cocula.

Les solicitamos para que aseguren la liberación des los ejidatarios Miguel Rebolledo, Víctor y Modesto Rebolledo Salinas.

En consecuencia, lamentamos:

1.    La detención violenta en su hogar, sin presentar ni orden de detención, ni de presentación, ni siquiera la razón de los posibles motivos de la acción judicial, no solo viola el derecho del debido procedimiento, sino las más elementales garantías individuales.

2.    La invención de delitos y la arbitrariedad judicial no reconstruye la debilidad institucional de los órganos de justicia, ni la necesaria credibilidad y legitimidad ante la ciudadanía del Estado de Guerrero.

3.    Exigimos detener la criminalización de la justa y legal resistencia ciudadana y la liberación de los ejidatarios Miguel Rebolledo, Víctor y Modesto Rebolledo Salinas;

4.    Asegurar la aplicación de la Ley Humanitaria Internacional de los Derechos  Humanos;

5.    Asegurar la aplicación de lo dispuesto por la Declaración sobre los Defensores de los Derechos Humanos, adoptada por la Asamblea General de la ONU el 9 de diciembre de 1998, en particular en lo referente a la protección del derecho de toda persona “individual o colectivamente, a promover y procurar la protección y realización de los derechos humanos y las libertades fundamentales en los planos nacional e internacional” (Art.1) así como en lo relativo al deber del Estado de garantizar “la protección [...] de toda persona, individual o colectivamente, frente a toda violencia o represalia, discriminación, negativa de hecho o de derecho, presión o cualquier otra acción arbitraria resultante del ejercicio legítimo de los derechos mencionados en la presente Declaración” (art.12.2);

6.    De manera general, garantizar el respeto por los derechos humanos y las libertades fundamentales en todo el país de conformidad con las normas internacionales de derechos humanos ratificadas por Mexico.
