I am writing to express my concern in regards to the case of Juan Manuel Martínez Moreno, who has been unjustly accused of the murder of the american journalist, Bradley Roland Will, which occurred on the 27th October 2006 in the state of Oaxaca, Mexico. Juan Manuel Martínez Moreno was arrested on the 16th October 2008 and is currently imprisoned in the state of Oaxaca, in the prison Ixcotel.
It is understood that two weeks after which Bradley Roland Will was murdered, Santiago Zárate and Aguilar Coello were arrested due to strong links that indicated their responsibility of the murder. However, they were released after two weeks and no further nvestigation into their involvement has been conducted. Two years later Juan Manuel Martínez Moreno was arrested and accused for the murder of Bradley Roland Will, despite the lack of formal investigation that in any way indicated his responsibility for the crime. The trial against Juan Manuel Martínez Moreno has been based solely upon two testimonies, neither of which directly indicates that Juan Manuel Martínez Moreno was responsible for the murder. It is worrying that both of these testimonies are imprecise and inconsistent: they are the only sources of evidence that exist against Juan Manuel Martínez Moreno, whilst there are seventy witnesses who have not in any way suggested that the accused Juan Manuel Martínez Moreno was responsible for the murder.
The judge responsible for the trial of Juan Manuel Martínez Moreno has disregarded the viewpoint of a group of independent experts from the International Program of Physicians for Human Rights, who have highlighted the inconsistencies and lack of clear evidence on which the investigation has been based. Furthermore, the judge has also disregarded the recommendation submitted by the National Commission of Human Rights (CNDH 050/2008), which brings attention to the fact that the bullets that killed Bradley Roland Will were fired from a distance of 32 meters and not from a distance of 2 meters, as has been suggested by the Attorney-General of the Republic (PGR).
I would like to strongly express my concern over the wellbeing and safety of the family of Juan Manuel Martínez Moreno, who have suffered multiple threats throughout the trial and are currently fearful for their lives.
Due to the strong lack of evidence that indicates the responsibility ofJuan Manuel Martínez Moreno for the crime, in addition to the inconsistencies that exist within the testimonies submitted against him, I find it of concern that he has been held without trial for several months and that his family continues to live in danger. I urge for the prompt release of Juan Manuel Martínez Moreno and for the conduction of a thorough investigation into the events of 27th October 2006 so that those responsible for the murder of Bradley Roland Will may be fairly prosecuted.
